14 states have adopted laws restricting everyone except licensed dentists, dental assistants, and dental hygienists from performing teeth-whitening procedures. Dental boards in at least a dozen additional jurisdictions have also tried to pass similar legislation.

In many US states, legal battles took place for years between state dental boards and non-dental teeth whitening providers in terms of the legal risks of doing teeth whitening. With such a lucrative industry, it is not surprising that dentists and dental organizations have tried to impose numerous bans on teeth whitening procedures in non-dental settings to avoid competition. However, 1-hour teeth whitening is a procedure that can be done by both dentistry professionals and non-dental professionals (in most states). Let me explain.

1-hour teeth whitening can be done by both dental and non-dental professionals because, in 2014, the FDA classified teeth whiteners as "cosmetics" (as opposed to a "drug").

In addition, in February 2015, The US Supreme Court ruled in favor of "antitrust laws" that allow non-dental professionals to promote teeth whitening services for "healthy competition" to the dentistry industry.

The state where teeth whitening is illegal and is considered a crime for non-dental industry professionals in Alabama. In Alabama, on June 5th, 2015 the Supreme Court upheld a 2011 state law restricting non-dentists from selling teeth whitening products and offering teeth whitening services. Non-dentists that violate this law by selling or performing teeth whitening in Alabama could face a misdemeanor crime, which can be punishable by a $5K fine and up to a year in jail.
